LEVI’S® RED TAB™ MEMBER PROGRAM TERMS & CONDITIONS
SECTION 1. OVERVIEW
These Levi’s® Red Tab™ Member Program (“Program”) Terms and Conditions (“Program Terms”), are Supplemental Terms under the Terms of Use and are part of the agreement between Levi Strauss & Co. ( “LS&Co.”). THE DISCLAIMERS; LIMITATIONS ON LIABILITY; INDEMNITY; GOVERNING LAW; SEVERABILITY; WAIVER; DISPUTE RESOLUTION; INFORMAL DISPUTE RESOLUTION; ARBITRATION AGREEMENT & WAIVER OF CERTAIN RIGHTS SECTIONS IN THE TERMS OF USE WILL, AS IF RESTATED IN THESE PROGRAM TERMS, GOVERN THESE PROGRAM TERMS AND ANY CONTROVERSY OR DISPUTE BETWEEN LS&CO. AND YOU ARISING OUT OF OR RELATED TO THESE PROGRAM TERMS OR THE PROGRAM. THIS INCLUDES THE REQUIREMENT FOR YOU AND LS&CO. TO RESOLVE DISPUTES THROUGH INDIVIDUAL, BINDING ARBITRATION AND NOT AS A CLASS ARBITRATION, CLASS ACTION, ANY OTHER KIND OF REPRESENTATIVE PROCEEDING, OR BY JURY TRIAL.
Please read these Program Terms carefully because they affect your legal rights. By participating in the Program, you become a "Member" and may be granted access to certain benefits at eligible Levi’s® store locations, via the Levi’s® mobile app, or online at www.levi.com (“Membership”). These Program Terms together with the Terms of Use constitute the entire agreement between you and LS&Co. relating to your use of and/or participation in the Program.

IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT PARTICIPATE IN THE PROGRAM.
SECTION 2. MEMBER’S ACCEPTANCE OF TERMS
Any additional terms and conditions, rules, regulations, policies and procedures we make available to you as part of the Program are incorporated into and form part of these Program Terms. By participating in the Program, you agree to the Program Terms. Each Member is responsible for remaining knowledgeable about the Program Terms.
SECTION 3. LS&CO.’S RIGHT TO CHANGE/CANCEL PROGRAM AND/OR TERMS
LS&Co. may, at its discretion, alter, limit or modify the Program structure or any other feature of the Program, including but not limited to Program benefits; how Points (defined below), Program Benefits (defined below) or other benefits are earned, calculated or redeemed; or the expiration date of Points or Program Benefits. LS&Co. reserves the right to change or modify these Program Terms or terminate the Program at any time, for any reason, without prior notice. Your continued participation in the Program after any such changes or modifications will confirm your acceptance of such changes or modifications.
SECTION 4. ELIGIBILITY
To participate in the Program, you must be a legal resident of the fifty (50) United States, the District of Columbia, or the United States territories, and eighteen (18) years of age or older. If you do not meet these eligibility requirements, you may not participate in the Program. A Member is not required to make purchases to qualify for the Program. LS&Co. reserves the right, in its sole discretion, to determine your eligibility for the Program.
SECTION 5. HOW TO PARTICIPATE
Participation in the Program is without charge and optional. To participate, you must provide the required information, including setup of a unique, qualifying password or entry of an existing levi.com password, at a qualifying Levi’s® store location, via the Levi’s® mobile app, or online at www.levi.com. Upon registering for the Program, individuals will receive an email confirming that they are a Member. You represent that all information you provide during registration and throughout your participation in the Program is true and accurate, and you agree to update such information, as necessary to maintain its truth and accuracy.
SECTION 6. POINTS, PROGRAM BENEFITS, AND EXCLUSIONS
Earning Points. By participating in the Program, Members will be eligible to begin earning points on eligible purchases (“Points”). For each $1 USD you spend on eligible purchases directly from eligible Levi’s® store locations, via the Levi’s® mobile app, or online at www.levi.com, you will receive 1 Point (Points will be rounded up if the subtotal ends in $0.01 or more). For a purchase to be eligible for Points, the purchase must be made after you accepted these Program Terms and you must provide your Membership information at the time of the purchase. Points cannot be purchased or transferred, are not redeemable for cash, and have no cash value. Exchange rates may apply to earning Points.
You will not earn Points on applicable taxes, shipping, or when purchasing a gift card or gift wrapping. Unless a discount specifies otherwise, any discounts applied to a transaction are applied equally to eligible and ineligible items in the transaction, and Points are not awarded on any discounted amounts. If you return an eligible purchase (in whole or in part) or a post-purchase price adjustment is made, Points will be deducted from your account to reflect the refund or adjustment.
Points typically show up in your account immediately if your purchase is made in store and upon shipment if your purchase is made online or in app, but some Points may take longer to show up. To prevent fraud and keep the Program viable for all Members, LS&Co. may impose additional limits on the number of Points that a Member can earn on a per-day or per-transaction basis.
Redeeming Points. You may redeem your Points for a reward. When making a purchase from eligible Levi’s® store locations, via the Levi’s® mobile app, or online at www.levi.com, you may redeem 125 Points for an electronic $5 USD discount (a “Reward”) that will be applied to the purchase. You cannot redeem more than 500 Points (for a maximum of $20 USD in Rewards) for any single purchase. Any Points earned beyond this threshold will continue to be credited to your account and can be applied to future eligible transactions. Rewards are for your personal use only and cannot be sold or transferred. Exchange rates may apply to earning Rewards.
To redeem a Reward, your purchase must be equivalent to or exceed the value of the Reward or Rewards being redeemed. Rewards will not apply automatically. Once you choose to apply your Rewards, the highest available Reward or Rewards based on the Points in your account will be applied. You may use Rewards in addition to a gift card, but you may not use Rewards to purchase a gift card. If you use Rewards to make a purchase and then make a return, you will receive a prorated number of any unexpired Points back in your account for the returned item(s).
Expiration of Points. All Points expire one year after becoming available in your account. When the Points expire, they will be removed from your account and can no longer be applied towards Rewards. If you return an item purchased with a Reward, any unexpired Points that were redeemed for the Reward will be credited back to your account and expire one year from the original date the Points became available in your account.
Other Program Benefits. You may also receive additional benefits by participating in the Program (“Program Benefits”) such as free shipping on orders over $75 USD, Points for your birthday, and exclusive offers. Ineligible transactions. Purchases at LS&Co. franchise stores are excluded from the Program. No Points will be awarded for purchases from franchise stores and Rewards are not redeemable at franchise stores. Purchases on Levi’s® SecondHand site and the sites of other LS&Co. brands are also excluded.
SECTION 7. GENERAL TERMS OF PROGRAM
Limit one (1) Membership per person. You may receive Program-related emails from LS&Co. while you are a Member (e.g., point balance emails). LS&Co. may also send Program-related notifications through the Levi’s® mobile app and via SMS. To not receive these Levi’s® mobile app or SMS notifications, a Member must opt out through the Member’s mobile phone and/or Levi’s® mobile app settings. See the SMS Terms for more details.

LS&Co. reserves the right, in its sole discretion, to suspend and/or terminate any Member’s participation in the Program for any reason, including suspected re-sellers and/or wholesalers, or in the event of any suspected fraud, abuse, or misuse in connection with this Program, which includes mass-buying by professional resellers. If an account is flagged as suspicious, LS&Co. may lock the account and trigger a password reset. In the case of fraud, abuse or misuse, the account may be terminated along with all benefits.
SECTION 8. TERMINATION
These Program Terms are effective unless and until terminated by LS&Co. or until your Membership is terminated by LS&Co. or you. Termination of your account will cause your Membership to be terminated. Should your Membership be terminated for any reason, you will lose all Points, Rewards and Program Benefits. If LS&Co. permits you to later rejoin the Program, you will not be credited with Points for past purchases and any Points, Rewards and Program Benefits earned during your prior Membership will not be restored to you. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Program Terms for all purposes.
