Sales. Under the laws of California, Colorado, Connecticut, Delaware, Montana, Nebraska, New Hampshire, New Jersey, Oregon, and Texas, the definition of “sale” is broad and covers many common commercial activities, even when the Personal Information used is not exchanged for money, or when the information does not directly identify you. LS&Co. discloses Contact Information (e.g, email addresses) and Identifiers (e.g., device id’s), Online and Technical Information (e.g., cookie id’s), and Inferred and Derived Information (e.g., customer preferences) for data analytics and marketing and advertising purposes, such as to better understand consumer engagement with our brand, to match your interests with similar products you may also be interested in, to offer advertising for LS&Co. products on third-party websites and applications, and to identify other consumers with interests similar to yours who may also be interested in our products. Under Iowa, Utah, and Virginia law, “selling” is the exchange of your Personal Information for monetary consideration only. LS&Co. does not sell your Personal Information for money to third parties for their independent business use, for example for their own marketing and advertising purposes.
Sharing and Targeted Advertising. Under California law, “share” or “sharing” means sharing, renting, releasing disclosing, disseminating making available, transferring or otherwise communicating orally, in writing, or by electronic or other means, your Personal Information by us to a third party for cross-context behavioral advertising, for monetary or other valuable consideration. The privacy laws of the other states listed above do not use the term “sharing,” but describe a similar concept, called processing for targeted advertising. As described in the “YOUR PERSONAL INFORMATION” and “COOKIES, TRACKING AND ADVERTISING” sections of our Privacy Policy, LS&Co. discloses certain categories of Personal Information for purposes that may be considered “sharing,” or use of Personal Information for “targeted advertising,” including to show you targeted ads on third-party properties (e.g., other websites or platforms).
We do not “sell,” “share,” or use Sensitive Personal Information (as defined under State Privacy Laws) for “targeted advertising.”
Opt-out Instructions. You may opt out of “sales,” “sharing,” or targeted advertising activities by clicking on Do Not Sell or Share My Personal Information. When opting out of cookie-based activities, you may need to renew your opt-out choice if you use a different browser or device to access our Platforms, or if you clear your cookies.
Where we are required to honor these signals by law, you can also opt out by visiting our Platforms with a legally recognized universal choice signal enabled (such as the Global Privacy Control). Note that if we can only identify your device or browser, we will only be able to apply the request to that specific device or browser and only for cookie or pixel based selling and sharing.
