If you are in the EU, the EEA (Iceland, Liechtenstein, and Norway), Switzerland or the UK or are otherwise subject to the General Data Protection Regulation, this section ("Supplemental Notice) applies to you. In the event of a conflict between the Privacy Notice and this Supplemental Notice, the provisions of this Supplemental Notice will apply to the extent needed to resolve the inconsistency or conflict.

A list of relevant LS&Co. group companies with whom your Personal Information will be shared can be reviewed here or requested at any time through the “CONTACT US” instructions in this Supplemental Notice below.

For EU/EEA/Switzerland and UK, “LS&Co.” and “we” as used in this Supplemental Notice means Levi Strauss & Co. Europe Comm. VA / SCA, a company organized and existing under the laws of Belgium, with offices at Airport Plaza – Rio Building, Leonardo Da Vincilaan 19, 1831 DIEGEM, BELGIUM registered at the Commercial Registry under number BE 0424.656.991. LS&Co will act as the controller for Personal Information of EU/EEA/Switzerland and UK data subjects.

We will only collect, use and share Personal Information where we are satisfied that we have an appropriate legal basis to do so. We process Personal Information in accordance with one of the following legal basis:

• Performance of the contract, or where steps have been taken to enter into a contract, between us to provide you with products and services including sending you transactional communications, verifying your identity, assisting you in-store, on the website or app, processing payments, returns, exchanges, orders, shipping products, and providing customer service.
• for purposes we consider to be in our legitimate interests as a commercial organisation including improving the functionality and integrity of our platforms and stores, keeping consumers up to date with information about our products and services, completing corporate transactions, understanding consumer preferences, to detect and prevent fraud and abuse, personalizing our interactions and developing our business relationship, as these functions help sustain and grow our business. In all such cases, we look after your Personal Information in a way that is proportionate and respects your privacy rights and you have the right to object to processing as explained in YOUR DATA SUBJECT RIGHTS.
• to comply with a legal obligation to which we may be subject, such as complying with orders from government or other legal authorities, detecting and preventing illegal conduct, abuse, spam, fraud (e.g., account takeovers or payment related fraud) security incidents and other harmful activities.

Where we are required by law to obtain your consent before processing Personal Information we will rely upon consent as our basis for processing. For example, obtaining your  consent for cookies intended for targeted advertising or collecting precise geolocation associated with a feature in our mobile app.  As part of gathering your consent, we will inform you of the purposes in advance, provide information on how to withdraw your consent along with the impacts of withdrawing your consent. Your Personal Information will be kept for as long as you are our customer and as necessary to fulfil the above-mentioned purposes. This includes purchasing products directly from us or through our partners which may include franchisees, wholesale operators or other fulfillment providers, engaging with our platforms and reviewing our content. Following the conclusion of our relationship, we may still retain certain information to the extent required or permitted by law. This includes storing Personal Information necessary for the compliance with legal obligations (such as tax and commercial laws) or for defending ourselves in legal disputes.

Information collected through cookies is retained for periods as set forth in our Cookie Preferences (see “MANAGING TRACKING TECHNOLOGIES” below). Some information, such as session cookies, is only kept for the time necessary to provide you with the relevant features of our websites or apps. • Right to Withdraw Consent, Object to or Restrict Processing: You have the right to (a) withdraw your consent to processing of your Personal Information, (b) request to restrict processing, or to (c) object to the processing of your Personal Information which has our legitimate interests as its legal basis, if you believe your fundamental rights and freedoms outweigh our legitimate interests. 
• Right to Obtain a Copy of Personal Information Safeguards: You can ask to obtain a copy of, or reference to, the safeguards under which your Personal Information is transferred outside of the European Union.
• Right to Avoid Automated-Decision Making: You have the right to not be subject to a decision based on automated processing of your Personal Information that has significant or legal effects without human intervention.

To authenticate your request, you must provide, at a minimum, your name and an email address and respond to a confirmation email that will be sent to that address. Only you, or someone legally authorized to act on your behalf and with written permission, may make a verifiable consumer request related to your Personal Information

• Right to Object to Use of Personal Information for Direct Marketing: You can request that we change the way we contact you for marketing purposes including by direct mail. Please see the instructions in the respective marketing communications for details on how to opt out or unsubscribe.
• Right to Lodge a Complaint with Your Local Supervisory Authority: We urge you to contact us to find a solution for any concern you may have about our data practices; however, you have a right to lodge a complaint with your local supervisory authority data protection authority (i.e., the authority of your place of habitual residence, place of work or place of alleged infringement) if you have concerns about how we are processing your Personal Information. Our websites and apps offered in the European Union (EU), European Economic Area (Iceland, Liechtenstein, and Norway), Switzerland and the UK are not intended to address anyone under the age of 16 (“Children”). We do not knowingly collect Personal Information from Children. If you are a parent or guardian and you are aware that your child has provided us with Personal Information without your consent, please contact us using information in the “CONTACT US" section above and we will take steps to remove that information.

Our websites and apps offered in the European Union (EU), European Economic Area (Iceland, Liechtenstein, and Norway), Switzerland and the UK offer a Cookie Preferences tool where you can learn more about the categories and specific types of cookies that are present and manage your choices.
